Acceptance of these terms
These Terms of Service govern your access to and use of Dynamic Lyrics, including the mobile application, related website content and any associated services we make available.
By downloading, accessing or using Dynamic Lyrics, you agree to be bound by these Terms of Service. If you do not agree, you must not use the service.
Eligibility and App Store terms
You may use Dynamic Lyrics only if you are legally able to enter into a binding agreement under applicable law. If you are using the app on behalf of an organization, you represent that you have authority to bind that organization to these terms.
If you downloaded Dynamic Lyrics from the Apple App Store, your use of the app must also comply with all applicable Apple terms, platform policies and usage rules. These Terms of Service are between you and Dynamic Lyrics, not Apple, and Apple is not responsible for the service except as required under applicable law.
To the extent permitted by law, Apple and its subsidiaries are third-party beneficiaries of these Terms of Service and may enforce them against you as a third-party beneficiary.
License to use the app
Subject to your compliance with these Terms of Service, Dynamic Lyrics grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and use the app for your personal, non-commercial use on Apple-branded devices that you own or control, as permitted by the Apple App Store terms and usage rules.
No ownership rights are transferred to you. We reserve all rights not expressly granted in these Terms of Service.
Accounts and connected music services
Some features may require you to sign in, connect a music account, or authorize third-party services such as Spotify or Apple Music. You are responsible for maintaining the security of your account credentials and any connected service authorizations.
You remain responsible for complying with the terms, permissions and subscription requirements of any third-party music service you connect to Dynamic Lyrics.
Acceptable use
You agree not to misuse Dynamic Lyrics or help anyone else do so. This includes, without limitation, the following:
- Violating any applicable law, regulation, third-party right, or platform policy.
- Copying, modifying, reverse engineering, decompiling, scraping, or attempting to extract source code or underlying components of the app except where such restriction is prohibited by law.
- Interfering with the security, stability, integrity, availability or performance of Dynamic Lyrics or related systems.
- Using the service to infringe intellectual property rights, distribute harmful material, or engage in abusive, fraudulent or deceptive conduct.
- Circumventing technical limitations, rate limits, access controls or feature restrictions.
Paid features and future offerings
Dynamic Lyrics may offer paid features, subscriptions, premium functionality or in-app purchases now or in the future. If we do, pricing, billing, renewal, cancellation and refund terms will be disclosed at the point of purchase or in additional terms that apply to those offerings.
Unless otherwise stated, all fees are non-refundable to the fullest extent permitted by law, subject to mandatory consumer rights and App Store rules.
Third-party services
Dynamic Lyrics may depend on third-party platforms, APIs, music services, hosting providers, analytics tools, diagnostics providers and other partners. We are not responsible for the availability, content, accuracy, security or practices of third-party services.
Your use of third-party services is governed by their own terms and privacy policies, and those third-party terms may apply in addition to these Terms of Service.
Intellectual property and feedback
Dynamic Lyrics and all related software, branding, designs, text, graphics, interfaces and other materials are owned by or licensed to us and are protected by applicable intellectual property laws.
If you provide feedback, suggestions or ideas regarding Dynamic Lyrics, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, modify and incorporate that feedback without restriction or compensation, unless prohibited by law.
Service availability and disclaimers
Dynamic Lyrics is provided on an “as is” and “as available” basis. We do not guarantee that the app will always be available, uninterrupted, secure, accurate, complete, compatible with every device, or free of bugs, delays or errors.
Lyrics availability, synchronization quality, music service integrations, widget behavior, Lock Screen features and CarPlay functionality may vary over time, by device, by operating system version, by region, or due to third-party platform changes.
To the fullest extent permitted by law, we disclaim all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Dynamic Lyrics and its owners, operators, affiliates, licensors, service providers and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, revenue, profits, goodwill, business opportunity or device functionality arising out of or related to your use of, or inability to use, the service.
To the fullest extent permitted by law, our total aggregate liability for claims arising out of or relating to Dynamic Lyrics will not exceed the greater of the amount you paid us, if any, for the service in the twelve months before the claim arose, or fifty U.S. dollars (US$50).
Nothing in these Terms of Service excludes or limits liability that cannot be excluded or limited under applicable law.
Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Dynamic Lyrics and its owners, operators, affiliates, licensors, service providers and partners from and against claims, liabilities, damages, losses and expenses arising out of or related to your misuse of the service, your violation of these Terms of Service, or your violation of any law or third-party right.
Suspension and termination
We may suspend, restrict or terminate your access to Dynamic Lyrics at any time, with or without notice, if we reasonably believe that you violated these Terms of Service, created risk or possible legal exposure for us, or if suspension is necessary to protect the service, other users or third parties.
You may stop using the service at any time. Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnity and dispute-related provisions.
Changes to these terms
We may update these Terms of Service from time to time. When we do, we may post the revised version in the app, on the website, or through another reasonable notice method.
Your continued use of Dynamic Lyrics after revised terms become effective means you accept the updated Terms of Service, to the extent permitted by applicable law.
